Prospective Marriage visa
This visa lets you come to Australia to marry your prospective spouse and then apply for a Partner visa.
- Enter and stay in Australia for up to 9 months from date of grant of visa.
- You can work studying in Australia.
- You can travel to and from Australia as many times as you want.
- Marry your prospective spouse within the 9 months and apply for partner visa onshore.
You must not be married when applying for this visa.

Subclasses 820&801
Partner Visa (Apply Onshore)
Allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia. You apply for the temporary and the permanent partner visas together.
With Temporary Partner visa (subclass 820):
- You can stay, travel and work in Australia for whole period of the Visa.
- You are entitled to attend free English language classes up to 510 hours provided by the Adult Migrant English Program.
- You can enrol in Medicare, which is Australia’s public health care scheme.
With Permanent Partner visa (subclass 801):
The visa is usually only for people who currently hold a temporary partner visa (subclass 820), letting the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently.
You must be sponsored by your spouse or de facto partner who must be Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
For Temporary Partner visa (subclass 820):
- You and sponsor are not related by family.
- You must prove that your relationship with your sponsor is genuine and continuing.
- You must live with your spouse or do not live apart a permanent basis.
- You and your spouse are committed to a shared life with exclusion of all others.
- Your relationship can be with someone of the same or different sex.
- Your sponsor is usually your partner. You cannot change your sponsor, which means the person who sponsors you when you lodge the application for the visa must be the same person who sponsors you when you are granted the 820 partner visa.
- To be a married applicant: Your marriage must be valid under Australian law.
- Usually the de facto relationship must have existed for at least 12 months immediately before you apply for the visa.
- Time spent dating or in an online relationship are not count as being in a de facto relationship.
- You might still be granted the visa if your relationship has broken down or if your sponsor died.
For Permanent Partner visa (subclass 801):
- You must still be in a relationship with your spouse or de facto partner, where you continue to be sponsored.
- You might still be eligible for the permanent visa if your relationship breaks down or if your sponsor dies after you have been granted the temporary visa but while Department of Home Affairs is still considering the permanent visa.

Subclasses 309&100
Partner Visa (Apply Offshore)
Allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia. You apply for the temporary and the permanent partner visas together.
With Temporary Partner visa (subclass 309) visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).
Permanent Partner visa (subclass 100) lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).
- You must be outside Australia when you apply and when the visa is granted.
- This is a partner visa that you apply for from outside of Australia.

For Temporary Partner visa (subclass 309):
- You and sponsor are not related by family.
- You must prove that your relationship with your sponsor is genuine and continuing.
- You must live with your spouse or do not live apart a permanent basis.

Sponsored Parent (Temporary) visa
This temporary visa lets a parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen visit Australia for up to 3 or 5 years.
- This temporary visa allows you to visit Australia for 3 or 5 years.
- You can re-apply for further Sponsored Parent (Temporary) visas to visit up to a maximum period of 10 years in Australia, but you cannot work in Australia while you hold this visa.
- This temporary visa visit Australia for up to 3 or 5 years.
- You must be the biological, legal (including adoptive) parent, step-parent or parent in-law of the sponsor who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
- There is no balance of family test or Assurance of Support requirements for this visa.
- The sponsor must pass the income test (currently AUD83,454.80 per year).

Parent visa & Aged Parent visa
This permanent visa lets an aged parent of a settle Australian citizen, Australian permanent resident or eligible New Zealand citizen stay in Australia.
Stay to work and study in Australia permanently and enrol in Australia’s public health care scheme.
Meet the balance-of-family test, if:
- At least half of your children and stepchildren, or
- There are more eligible children living in Australia than in any other single country.
Must be sponsored by a child who is an Australian citizen or permanent resident.
The sponsor must be a lawfully resident in Australia for at least 2 years.
An assurance of support is required in all cases.
This category requires payment of a high second instalment of visa application charge, designed to support early access (4-5 years of waiting) to Medicare and any other services the applicant is eligible for upon becoming a permanent resident.

Child visa
Subclass 101 visa lets a child outside Australia move to Australia to live with their parents. Subclass 802 visa allows a child to stay in Australia permanently and live with their parents.
Enter and live with parents in Australia indefinitely, and enrol in Australia’s Medicare Scheme in Australia.
Age requirements
You must be either:
- under 18 years old, or
- over 18 and under 25 years and studying full time, or
- over 18 years with a disability
The relationship between the child and the sponsor
- Biological child
- Adopted children
- Stepchildren
*An adopted child must have been adopted before their parent became an Australian citizen or the holder of an Australian permanent resident visa or an eligible New Zealand citizen.
*A step child who has not turned 18 of a step-parent who is no longer the partner of the child’s parent but has a legal responsibility to care for the child.
